greatsouthernhomes.com.au is operated by M.S. Building Pty Ltd (ACN 138 748 375, ABN 89 138 748 375) trading as Great Southern Homes, WA Registered Builder BC 50814. In these terms, "we", "us" and "our" mean Great Southern Homes, and "you" means anyone using this website.

These terms apply when you use this website. By continuing to use it, you agree to them. If you do not agree, please do not use the website. Read these terms together with our Privacy Policy.

Nothing in these terms excludes, restricts or changes any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), the Home Building Contracts Act 1991 (WA), or any other law that cannot lawfully be excluded, restricted or changed.

Every other term on this page applies subject to those rights. Where a law does not allow a term on this page to apply to you, that term does not apply to you, and the rest of these terms still do.

No. Content on this website is general information about us and how we work. We take care to keep it accurate and up to date, but it is not an offer, quote, estimate or tender. It is also not building, engineering, planning, legal or financial advice for your site or situation.

Every block, design and budget is different. Before you make decisions, talk to us and to your own advisers about your project.

We only agree to build for you, and only for a particular scope and price basis, in a written building contract signed by you and us.

Your building contract comes first. These terms do not form part of, and do not change, any building contract you sign with us. If anything on this website is inconsistent with your building contract, your building contract prevails to the extent of the inconsistency.

Photos and images. Photos of completed homes may show furniture, landscaping, window treatments, fittings or finishes chosen by those owners. Your home will include what your contract and selections specify. Some images on this website are illustrative and are not photographs of homes we built. Homes we built are identified as our projects.

Plans and drawings. Any plans, sketches or drawings shown are indicative. Dimensions are approximate, and designs change through council, engineering and energy requirements.

Case studies. Case studies describe real projects we completed. Costs, timeframes and site conditions on any project were specific to that project and that time, and are not a prediction for yours.

Testimonials. Testimonials are from real clients, published with their consent, and describe each client's own experience. We have not paid for or given anything in return for them. We do not stop clients from posting honest reviews of us anywhere.

Awards. Awards we mention name the awarding body, category and year. They recognise the project named, not every home we build.

We build under cost-plus contracts. Under a cost-plus contract, the final price depends on the actual cost of labour and materials plus our agreed fee, so we do not publish fixed prices.

Any cost ranges, budgets or timeframes on this website are general guidance based on past projects. They do not include your site costs, council and approval fees, service connections or the selections you make. Your project's estimate and price basis are set out in writing before you sign a contract.

All amounts on this website are in Australian dollars and include GST unless we say otherwise.

We own, or are licensed to use, the content on this website. That includes the text, photos, plans, drawings, designs, logos and the Great Southern Homes name. It is protected by the Copyright Act 1968 (Cth) and other intellectual property laws.

You may view, download and print content for your own personal use, such as planning your build with us. You must not copy, republish, sell or adapt it for any other purpose without our written permission. In particular, you must not build from, or give a builder, any plan or design shown on this website.

You must not:

• use this website for anything unlawful
• send false, offensive or misleading information through our forms
• upload or send viruses or other harmful code
• try to get around our security or spam protection
• scrape, copy or harvest content or contact details using automated tools
• interfere with the website or with anyone else's use of it

We aim to keep the website available and accurate, but we may change, suspend or remove any part of it at any time. We do not promise that it will always be available or free of errors or viruses.

Links to other websites. We link to other websites, such as our Instagram page and government websites, for your convenience. We do not control those websites, and we are not responsible for their content or how they handle your personal information.

Subject to your rights under the Australian Consumer Law and other laws that cannot be excluded, we are not responsible for loss you suffer because you relied on general information on this website instead of getting advice about your own project.

This does not limit our responsibility for:

• our obligations under any quote or building contract with you

If you deliberately misuse this website in breach of the section on using this site, you are responsible for the loss that misuse causes us, to the extent you caused it.

Our Privacy Policy explains how we collect and handle personal information, including what our contact form and our analytics, session recording and advertising tools collect.

We may update these terms by publishing a new version on this page, with a new date at the top. A change applies only to your use of the website after it is published. Changes to these terms never change a quote or building contract already made with you.

These terms are governed by the laws of Western Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia. This does not affect your right to take a building dispute to the Building Commissioner or to the State Administrative Tribunal.
